These Terms of Service ("Terms", "Terms of Service") govern your use of our website located at bigallihats.com (together or individually the "Service") operated by YANAPI SA
Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard, and disclose information resulting from your use of our websites.
Your agreement with us includes these Terms and our Privacy Policy ("Agreements"). You acknowledge that you have read and understood the Agreements and agree to be bound by them.
If you do not agree with (or cannot comply with) the Agreements and may not use the Service, please let us know by emailing fabrizio@bigallihats.com so we can try to find a solution. These Terms apply to all visitors, users, and others who wish to access or use the Service.

2. Communications

By using our Service, you agree to subscribe to newsletters, marketing or promotional materials, and other information we may send. However, you may opt out of receiving some or all of these communications from us by following the unsubscribe link or by emailing fabrizio@bigallihats.com.

3. Shopping

If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit or debit card number, the expiration date of your card, your billing address, and your shipping information.
You represent and warrant that: (i) you have the legal right to use any card or other payment method in connection with any Purchase; and (ii) the information you provide to us is true, correct, and complete.
We may employ third-party services to facilitate payment and complete Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.
We reserve the right to refuse or cancel your order at any time for reasons including, but not limited to: product or service availability, errors in the description or price of the product or service, error in your order, or other reasons.
We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

4. Shipping and delivery

Orders are shipped within 72 business hours after receiving your order and once payment has been confirmed by the customer's bank or payment system of choice. Some items may take longer for reasons beyond our control. We will contact you by email if your order is delayed.
Packages are shipped via DHL (outside Ecuador) or Servientrega (only in Ecuador, where available). This service will take between 3 and 5 business days to deliver your package.
Shipping rates are calculated based on the number of hats ordered and the destination you wish to ship them to. A flat rate applies to Ecuador.

Import Duties, Taxes, and Expenses.- If any product is shipped outside of Ecuadorian territory, the payment of Duties, Taxes, and taxes at destination will be the responsibility of the BUYER.
The amounts previously paid by the BUYER will cover the shipping costs.

5. Contests, sweepstakes and promotions

Contests, sweepstakes, or other promotions (collectively, "Promotions") available through the Service may be governed by rules separate from these Terms of Service. If you participate in a Promotion, please review the applicable rules, as well as our Privacy Policy. If a Promotion's rules conflict with these Terms of Service, the Promotion's rules will apply.

6. Returns and refunds

Orders can be returned to the warehouse for a refund within 30 days. Returns must be unused, in the condition in which they were received, and in the original packaging. Return shipping must be paid in full by the customer. In cases where the item is damaged or did not ship as ordered, a return credit note will be provided. Refunds for the original shipping cost are not issued.
We issue credit notes for orders within 7-12 business days after the original purchase of the Contract and the arrival of the returned product to our warehouse.

7. Content

The content found on or through this Service is either the property of YANAPI SA or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use such Content, whether in whole or in part, for commercial purposes or personal gain, without our prior written permission.

8. Prohibited uses

You may use the Service only for lawful purposes and in accordance with the Terms. You agree not to use the Service:
0.1. In any way that violates any applicable national or international law or regulation.

0.2. For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.

0.3. To transmit or procure the sending of any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.

0.4. To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.

0.5. In any way that infringes the rights of others, or in any way that is unlawful, threatening, fraudulent, or harmful, or in connection with any unlawful, fraudulent, or harmful purpose or activity.

0.6. Engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm or offend the Company or users of the Service, or expose them to liability.

Additionally, you agree not to:
0.1. Use the Service in any manner that could disable, overburden, damage, or impair the Service or interfere with any other party's use of the Service, including their ability to engage in real-time activities through the Service.

10. Prohibition of use by minors

The Service is intended solely for access and use by persons at least eighteen (18) years of age. The Service and its original content (excluding user-provided content), features, and functionality are and will remain the exclusive property of YANAPI SA and its licensors. The Service is protected by copyright, trademark, and other laws of foreign countries. Our trademarks may not be used in connection with any product or service without YANAPI SA 's prior written consent.

You may provide us directly at fabrizio@bigallihats.com or through third-party sites and tools with information and feedback about bugs, improvement suggestions, ideas, problems, complaints, and other matters related to our Service ("Feedback"). You acknowledge and agree that: (i) you shall not retain, acquire, or assert any intellectual property or other right, title, or interest in or to the Feedback; (ii) the Company may have development ideas similar to the Feedback; (iii) the Feedback does not contain any confidential or proprietary information of you or any third party; and (iv) the Company is under no obligation of confidentiality with respect to the Feedback. 17. Termination

These Terms shall be governed by and construed in accordance with the laws of Ecuador, which shall apply to these agreements without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.

We reserve the right to withdraw or amend our Service and any services or materials we provide through the Service, at our sole discretion and without prior notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Service, or the entire Service, to users, including registered users.
